DLA Piper recently achieved a significant victory for Pulte Homes, Inc., Lennar Corporation (formerly The Ryland Group, Inc. and CalAtlantic Homes), Shea Homes, and Taylor Morrison, Inc., defendants in a decade-long patent infringement suit. On November 5, the US Supreme Court denied a petition for certiorari filed by plaintiff Real Estate Alliance Ltd., upholding a former Federal Circuit decision in favor of the group of home builders.
The suit, which began in 2007, centered around two patents describing software for locating real estate properties on a computerized map. DLA Piper asserted that these patents were invalid, and in December 2016, after years of litigation, a federal district court judge agreed. The Court of Appeals for the Federal Circuit affirmed that finding in February 2018. Real Estate Alliance Ltd., the patent owner, filed a petition for certiorari in August, which was denied on November 5 based on arguments presented by DLA Piper.
