In that case, Mercer County Assignment Judge Mary C. Jacobson found that the individual's conviction, which occurred after his retirement as a public school superintendent, did not touch on that public office and, therefore, that his pension benefits should resume, with retroactive payment of the benefits that had been withheld. As a result, Judge Jacobson ordered the state Pension Board to reinstate the pension.
