Michael Conley, Shareholder and Managing Partner of Offit Kurman’s Philadelphia office as well as chair of the Insurance Recovery practice group, was quoted in an article published in the Legal Intelligencer on a recent decision regarding the insurance implications for Penn State in reference to Jerry Sandusky’s sex abuse scandal. While referring to the decision made by Judge Gary Glazer and Penn States motion requesting interlocutory appeal from said ruling, Mr. Conley says in the article, “The portions of Judge Glazer’s opinion where he is talking about Penn State having to bear some responsibility for their acts, that very well may be true, but I don’t know if that’s the analysis that should be done in this context,” Conley said. “Understanding PMA’s argument is one thing, but whether PMA has an argument that makes sense isn’t the end of the analysis. The law requires that PMA establish that Penn State’s interpretation is unreasonable.” He continues to explain “I certainly would understand, and agree that this would be a good issue for the Superior Court to hear.”
